The Oil Pollution and Hazardous Substances Control Act of 1978
requires the owner of any petroleum UST to immediately notify the State environmental authorities and take immediate action to abate the release and restore the affected area to prerelease conditions. This law was passed to "promote the health, safety, and welfare of the citizens of this State by protecting the land and waters over which this State has jurisdiction from pollution by oil, oil products, oil by-products, and hazardous substances."
Although most home heating oil USTs are non-regulated, should leakage be discovered, the regulations protecting soil and groundwater will enforce the assessment and cleanup of the leakage.
